The ice cream maker is facing a new legal challenge after it was fined $500,000 for misleading consumers about the effectiveness of its product.
A judge in Colorado has already suspended the amount of the offending label on the product, which claims to help treat erectile dysfunction. The decision was based on the company’s claim that the product contains an ingredient which is not listed in the label and therefore does not pose an unreasonable risk of serious harm.
A spokesperson for the company said: “In this case, the court ordered the product to be immediately suspended for one month.”
The offending label claims to contain sildenafil, an ingredient found in Viagra.
The product, which is sold in packs of four, can be used for erectile dysfunction in men under the age of 18. However, there is no link between the product and the sexual activity of a person under 18.
The product was found to contain a low dose of sildenafil, which was not included in the label.
According to a spokesman for the company, “we’ve received reports from customers who have purchased the product and we are taking all appropriate measures to ensure this product is safe for them to use.”
“The product was originally sold as an ice cream, which was not intended to be a health product. In addition, the company said it intended to market the ice cream in the United States.”
The case was heard by Judge David C. Cramer during a hearing in Colorado in which he confirmed that the label “should not have been adhered to.”
The judge said the company had been trying to sell the product to men who have never had erectile dysfunction, but that it had not been effective in treating the condition.
“The company had failed to adequately disclose the information that was being communicated to the customer. That is, it should not have been used in this manner,” Cramer said. “This was not a product that could have been marketed to men who have had difficulty getting an erection.”
“It’s clear that the company knew about the information in this label and it had never done so. The product has been sold in the United States for more than $1 million.”
Cramer also said he would not be allowed to issue a ruling on the product in future cases.
In the meantime, there is a “very high risk” that the company will be fined.
“The company is making a statement to the court that we are going to take action to investigate the case and we will make appropriate decisions on whether or not we will be found to be liable.”
According to the company, “there are currently no pending cases pending in Colorado involving any of the products identified in the label.”
